Care home responsible for the safety of its employees

Mrs H of Linconshire was working as a care assistant at a care home when she was injured whilst helping an elderly resident to use the toliet. She aggravated a pre-existing back problem.

A claim was made against the care home who employed her.

She had not been given any formal lifting training or instruction in breach of health and safety law.

Liability was contested to begin with but following disclosure of relevant documents, the insurers made an admission of liability.

The claim settled for £5,000 in compensation.
