Planes, Boats and Trains
If you are injured whilst travelling abroad by plane or boat or train, your right to claim damages is determined by either the Montreal or Athens or Berne Conventions which are international laws on air, sea and rail travel respectively.
The Conventions are not straightforward. For example:
The Montreal Convention can apply even when the accident does not occur in flight nor indeed on board the aircraft but in the course of embarking or disembarking.
The Warsaw Convention only applies if you suffer injury while being carried on a sea going vessel.
The Berne Convention in certain circumstances requires that you give notice of your claim within 3 months of becoming aware of it.
There are strict 2 year time limits in which to bring claims under the Montreal and Athens Conventions.
