Personal Injury


A claim for personal injury may arise if you are injured through no fault of your own. This can be an injury at work, in a road traffic accident, an injury suffered as a result of tripping in the street or maybe slipping in a shop or an injury suffered by the victim of a violent crime. It may even be an accident abroad perhaps whilst you are on holiday.

You are able to make a claim for personal injury because over many years the law has developed to help protect us from the negligence or fault of others in all areas of our lives. You are entitled to expect that your employers, colleagues at work, other road users and even the owners of premises you visit will take reasonable steps to keep you safe and/or will not do anything that exposes you to the risk of harm.

So if you are injured by falling objects at work because a work colleague has failed to stack the objects safely or if you are injured in a shop because you slip on a spillage that was not cleaned up or if you are injured when another driver runs into the back of your vehicle whilst you are stationary at traffic lights because he fails to stop in time, you are entitled to bring a claim for compensation against the person or company who injured you. In the case of the work colleague, the claim will almost always be against your employer as they have to make sure that your colleagues are properly trained, instructed and supervised to reduce the risk of accidents occurring so when an accident does occur they will usually be responsible.

The right to claim compensation in this country means that insurance cover is compulsory for all drivers and that a prudent employer will always have insurance cover so if a claim is made it will be dealt with by the insurer. Household insurance which most of us have often includes insurance cover against accidents in our homes.
